These Terms of Service ("Terms") are a binding agreement between you and Offermesh Network, doing business as Randomness As a Service ("Company," "we," "us," or "our"). These Terms govern your access to and use of our website, dashboard, APIs, documentation, billing surfaces, support channels, and related services (collectively, the "Service").
By creating an account, clicking to accept these Terms, starting a free trial, subscribing to a paid plan, generating outputs through the Service, or otherwise accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
If you accept these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have authority to bind that entity. In that case, "you" and "your" refer to that entity.
If additional order forms, plan-specific terms, promotional terms, or product-specific terms apply to a particular feature or offer, those additional terms are incorporated into these Terms. If there is a conflict, the more specific terms control for that feature or offer.
1. Definitions
For clarity, the following definitions apply in these Terms:
- "Account" means your registered account for the Service.
- "API Key" means a credential issued by the Service that authorizes API access for your Account.
- "Dashboard" means the authenticated account-management interface for the Service.
- "Documentation" means the technical, product, billing, usage, and support materials we make available for the Service.
- "Output" means a generated result returned by the Service in response to a valid request, including words, numbers, names, surnames, or future supported generator outputs.
- "Subscription Term" means the active billing period for a paid subscription or the active period for a free trial, as applicable.
- "Support Credits" means promotional, goodwill, or administrative token credits granted by us outside the standard subscription allocation model.
- "Tokens" means the internal usage units consumed by successful generation requests under the rules described in these Terms and the Documentation.
- "User Content" means data, request parameters, account information, support submissions, and other materials you submit to or through the Service, excluding Output and excluding our own systems, software, and datasets.
2. Eligibility and Permitted Use
You may use the Service only if:
- you are at least 18 years old and legally able to enter into a binding contract;
- you are not prohibited from using the Service under applicable law;
- you are not using the Service on behalf of a sanctioned or restricted person or entity in violation of applicable export, sanctions, or trade-control laws; and
- all information you provide to us is accurate, complete, and kept up to date.
The Service is intended primarily for professional and business use. If consumer-protection laws apply to your use, nothing in these Terms limits any non-waivable rights you may have under those laws.
3. The Service
Randomness As a Service is a subscription platform for structured random-value generation. At launch, the Service supports random words by locale, random numbers by range, random first names by locale and gender, and random surnames by locale. We may add, modify, or remove generators, locales, limits, or features over time.
The Service is designed as production-oriented infrastructure, but it is not certified for any regulated or safety-critical use that requires certified randomness, hardware entropy, auditable fairness controls, gambling compliance, or legally mandated statistical guarantees unless we expressly state otherwise in a signed agreement.
We may publish Documentation describing supported locales, request formats, batch constraints, precision rules, operational limits, and error codes. You are responsible for implementing against the then-current Documentation.
4. Account Registration, Verification, and Security
You must create an Account to access the Dashboard, start a trial, purchase a subscription, or manage API Keys.
You agree that:
- you will provide a valid email address and maintain access to it;
- you will complete any required verification steps, including email verification, before using gated parts of the Service;
- you will keep your login credentials confidential;
- you will not share Account credentials between multiple people;
- you are responsible for all activity occurring under your Account, whether or not authorized by you; and
- you will notify us promptly at
[email protected]if you suspect unauthorized access, credential compromise, or security misuse.
We may refuse registration, require additional verification, or suspend access if we reasonably believe your information is inaccurate, your Account presents fraud or security risk, or your use may violate these Terms or applicable law.
5. Email Verification and Access Controls
Email verification is mandatory before dashboard access and API access. We may limit, suspend, or deny access to the Dashboard, billing surfaces, API Key issuance, or API functionality until verification is completed.
We may also require re-verification or additional identity checks where reasonably necessary for security, billing integrity, fraud prevention, or legal compliance.
6. API Keys
Your Account may create up to 10 active API Keys unless we expressly permit otherwise.
You are solely responsible for:
- creating, naming, storing, and using API Keys securely;
- limiting access to API Keys to authorized personnel and systems;
- rotating or regenerating API Keys when compromise is suspected;
- all requests made using your API Keys; and
- ensuring your applications handle errors, retries, limits, and revocation correctly.
Revoked API Keys stop working immediately. Regenerated API Keys invalidate the previous secret immediately. You must treat every API Key as a secret. You may not expose API Keys in public repositories, client-side code, unsecured logs, or any other location where unauthorized parties could obtain them.
We may display limited metadata for API Keys in the Dashboard, such as key name, environment label, last-used timestamp, and aggregated usage visibility.
7. Acceptable Use and Restrictions
You may use the Service only in compliance with these Terms, the Documentation, and applicable law. You may not, and may not permit others to:
- use the Service for unlawful, fraudulent, deceptive, or abusive activity;
- interfere with, disrupt, or attempt to bypass the Service's limits, security controls, authentication flows, or monitoring;
- probe, scan, or test the vulnerability of the Service except through an authorized disclosure process approved by us in writing;
- use the Service in a way that degrades platform stability or creates unreasonable operational burden;
- resell, lease, sublicense, or offer the Service on a standalone basis to third parties, except as a permitted part of your own product or internal workflow;
- use the Service to build a directly competing dataset, service, or model by systematically extracting or reconstructing our proprietary data sources, output distributions, or product logic;
- use the Service in connection with malware, credential attacks, spam, denial-of-service activity, or unlawful surveillance;
- use the Service to violate privacy, publicity, discrimination, consumer-protection, or intellectual-property rights;
- misrepresent Output as unique, certified, or guaranteed for regulated fairness use when it is not;
- use the Service as the sole basis for medical, legal, safety-critical, election-related, gambling, lottery, or other regulated decisions requiring certified randomness or specialized controls;
- attempt to reverse engineer, decompile, or otherwise derive source code or non-public internals of the Service, except to the extent such restriction is prohibited by law; or
- access or use the Service from jurisdictions or by persons where such use would violate applicable law or our country availability restrictions.
We may investigate suspected misuse and cooperate with law enforcement, regulators, payment providers, and network operators where reasonably necessary.
8. Free Trials
We may offer a free trial subject to eligibility rules, billing qualification checks, and promotional conditions.
Unless we state otherwise in a specific offer, the launch free trial includes:
- 7 days of access; and
- 5,000 trial Tokens.
Current business rules for the launch trial are as follows:
- you must complete mandatory email verification;
- you must complete any required payment-method qualification checks before access is activated;
- you select an intended paid plan when starting the trial;
- you may change the intended paid plan during the trial; and
- the final selected paid plan begins automatically at the end of the trial unless canceled before conversion through the cancellation method we make available.
If the automatic start of the selected paid plan fails at the end of the trial, access may stop immediately and any remaining trial entitlement may expire.
Free trials are limited to one per person, payment method, organization, and/or other criteria we reasonably use to prevent abuse, unless we expressly state otherwise. We may modify, revoke, or terminate a trial offer at any time to address fraud, abuse, or error.
9. Subscriptions, Renewals, and Plan Changes
Under the current launch pricing model:
- a monthly plan priced at USD $5 per month; and
- a yearly plan priced at USD $40 per year.
Unless required otherwise by applicable law, paid subscriptions renew automatically at the end of each Subscription Term until canceled.
If you subscribe:
- you authorize us and our billing providers to charge the applicable fees, taxes, and other disclosed amounts using your selected payment method;
- your subscription remains active through the end of the current paid billing period if you cancel before renewal;
- switching between monthly and yearly plans takes effect at the next renewal only;
- no proration applies to plan switches unless we explicitly state otherwise; and
- at renewal following a plan switch, the old plan's active entitlement ends and the new plan's entitlement begins.
We may change pricing prospectively by giving notice required by applicable law or reasonably appropriate under the circumstances. Any price change will take effect no earlier than your next renewal after the notice period, unless applicable law requires a different process.
10. Tokens, Usage Metering, and Support Credits
Tokens are a contractual usage unit within the Service. Tokens are not money, are not a deposit account, do not represent stored value, are not transferable property, are not redeemable for cash, and cannot be sold, assigned, or transferred except as we expressly permit.
10.1 Subscription allocations
Based on the current launch model:
- the monthly plan receives 10,000,000 Tokens at each monthly renewal;
- the yearly plan receives 10,000,000 Tokens each month during the annual term, aligned to the billing-provider cycle anchor; and
- unused subscription Tokens expire 7 days after the relevant monthly refresh.
Prior-cycle subscription Tokens may remain usable for up to 7 days after a refresh and then expire.
10.2 Trial allocations
Trial Tokens expire at the end of the trial unless we expressly state otherwise.
10.3 Support Credits
Support Credits, if any, are separate from subscription allocations. Support Credits may have separate expiry dates, priority rules, or restrictions set at the time they are granted. Support Credits are not customer-purchasable top-ups unless we expressly launch such functionality in the future.
10.4 Usage rules
Unless we expressly state otherwise in the Documentation:
- each successful generated item costs 1 Token before any batch discount;
- batch requests are eligible for a 10% discount when they satisfy the then-current batch rules;
- discounted batch cost is rounded down to 2 decimal places;
- decimal Token balances may be used to 2 decimal places;
- the current minimum valid batch size is 10 items; and
- the current maximum valid batch size is the limit shown in the Documentation or product UI.
If any item in a batch is invalid, the entire batch fails and consumes zero Tokens. If the total batch cost exceeds available balance, the entire batch fails and consumes zero Tokens. Invalid requests, unsupported locale requests, rate-limited requests, and internal server errors consume zero Tokens.
Token debiting occurs only after the full request passes validation and balance checks.
We may correct obvious accounting errors, reverse erroneous grants, or adjust balances to address fraud, billing failures, refunds, chargebacks, duplicate processing, or other integrity issues, provided we maintain appropriate internal records.
11. Payment, Billing Providers, Taxes, and Currency
We may use third-party billing, subscription-management, and payment providers, including RevenueCat and underlying payment processors. Your use of those billing surfaces may also be subject to the provider's applicable terms and privacy notices.
You agree to keep a valid payment method on file where required for a trial or subscription. If your payment method cannot be charged, expires, is declined, or becomes invalid, you authorize us and our billing providers to retry charges as permitted by law and card-network rules.
Except where required by law or expressly stated otherwise:
- fees are payable in advance;
- fees are non-refundable;
- you are responsible for applicable taxes, duties, levies, or similar governmental charges associated with your subscription; and
- displayed pricing is exclusive of taxes unless we explicitly state otherwise.
Pricing currency, tax handling, and country availability may vary by billing provider, your location, or applicable law. We may restrict access, billing, or plan availability by country or jurisdiction.
12. Failed Payments, Grace Periods, Refunds, and Chargebacks
If a recurring payment fails, we may place your Account into a billing-problem state. Under the current launch policy:
- a failed paid renewal receives a 1-week grace period;
- during the grace period, API access remains active;
- after the grace period ends, the relevant Tokens expire; and
- if automatic paid-plan start fails after a free trial, access may stop immediately.
If a paid subscription is canceled, Service access remains active until the end of the current paid billing period, subject to these Terms.
If a subscription expires, API access ends immediately. Dashboard access may remain available on a limited basis subject to retention windows and applicable law.
If we grant a refund:
- API access may end immediately;
- remaining Tokens may be revoked immediately; and
- any future renewals may be canceled.
Subject to applicable law, if you initiate a chargeback, payment dispute, reversal, or similar recovery action:
- we may suspend or terminate your Account or subscription;
- we may revoke remaining Tokens or Support Credits associated with the disputed payment; and
- you remain responsible for any valid unpaid amounts and related costs we incur, to the extent permitted by law.
Nothing in this section limits any rights you may have under non-waivable consumer-protection law.
13. Rate Limits, Technical Limits, and Service Protections
We may apply operational limits and abuse-prevention controls, including account-level rate limits, throughput limits, concurrency limits, and batch limits.
Under the current launch configuration, we expect account-level limits of up to:
- 1,000 HTTP requests per second per account; and
- 5,000 generated items per second per account.
These limits may change at any time to protect service integrity, manage abuse, or reflect product changes. We may reject, throttle, queue, or block requests that exceed applicable limits or threaten the security, reliability, or availability of the Service.
14. Output Characteristics and Customer Responsibilities
You acknowledge and agree that:
- Output may contain duplicates across requests or within a batch;
- Output is not guaranteed to be unique, exclusive, exhaustive, or fit for any particular purpose;
- supported locales, gender values, numeric precision, and other request constraints are limited to what is described in the Documentation;
- unsupported locale requests or invalid parameters may fail without producing Output;
- request validation and machine-readable error handling are part of your integration responsibilities; and
- you are responsible for evaluating whether the Service and Output are appropriate for your use case.
The Service uses operating-system cryptographically secure random-number generation for launch unless we state otherwise. We do not represent that the Service satisfies any specialized legal, certification, or audit standard for regulated randomization use.
15. Customer Data, Privacy, and Security
Our collection, use, and disclosure of personal information is described in our Privacy Policy: Privacy Policy.
You grant us the right to host, process, transmit, store, analyze, and otherwise use User Content as necessary to:
- provide and secure the Service;
- authenticate users and API requests;
- meter usage and enforce entitlements;
- prevent fraud, abuse, and security threats;
- provide support;
- comply with law; and
- improve, operate, and maintain the Service.
You represent and warrant that you have all rights, notices, permissions, and lawful bases necessary to submit User Content to the Service and to instruct us to process it as contemplated by these Terms.
You are responsible for the accuracy, legality, quality, and integrity of User Content. We are not responsible for errors in requests, malformed integrations, unsupported parameter combinations, or downstream uses of Output.
We implement reasonable administrative, technical, and organizational safeguards appropriate to the nature of the Service, but no system is perfectly secure and we do not guarantee absolute security.
16. Retention, Account Deletion, and Anonymization
You may request deletion of your Account by using the deletion method we make available or by contacting [email protected].
Under the current launch policy:
- deleted Accounts are anonymized after 30 days rather than immediately hard-deleted;
- customer-facing request logs and usage history are generally limited to 30 days;
- API Key metadata is generally limited to 60 days;
- billing-history visibility is generally limited to 60 days; and
- admin audit records are retained for up to 180 days.
These windows may be adjusted where necessary for security, fraud prevention, dispute resolution, chargeback handling, legal compliance, backup integrity, or legitimate internal recordkeeping. We may retain de-identified, aggregated, anonymized, or legally required records after Account closure.
Because the field-level anonymization matrix is still a business and legal work item, any public privacy and deletion disclosures should be reviewed together before publication.
17. Intellectual Property and Proprietary Rights
The Service, including its software, interfaces, branding, Documentation, data structures, design, selection and arrangement of content, and underlying proprietary datasets, is owned by the Company or its licensors and is protected by intellectual-property and other applicable laws.
Except for the limited rights expressly granted in these Terms, no rights are granted to you by implication, estoppel, or otherwise.
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable right during the applicable Subscription Term to access and use the Service for your internal business purposes and to integrate the API into your own products and workflows.
You may use Output in your business and products, subject to these Terms, applicable law, and any third-party rights that may apply. However:
- we do not transfer any ownership in the Service, Documentation, or our underlying datasets;
- we do not grant exclusivity in any Output;
- we do not guarantee that similar or identical Output will not be generated for you or others; and
- you may not use Output or the Service to reconstruct or replicate our proprietary data assets or service logic.
18. Feedback
If you provide suggestions, ideas, bug reports, product feedback, or other feedback, you grant us a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free right to use that feedback for any lawful purpose without restriction or compensation to you.
19. Third-Party Services
The Service may interoperate with or depend on third-party services, including payment processors, billing providers, infrastructure providers, email providers, or analytics and security vendors. We are not responsible for third-party services, and your use of them may be subject to separate terms and privacy notices.
We may change third-party providers at any time as part of operating the Service.
20. Suspension and Termination
We may suspend, restrict, or terminate all or part of your access to the Service immediately, with or without prior notice, if we reasonably determine that:
- you breached these Terms or the Documentation;
- your use is unlawful, fraudulent, deceptive, or abusive;
- your use threatens the security, integrity, or availability of the Service;
- you attempt to evade rate limits, billing rules, or access controls;
- your payment is overdue, reversed, disputed, or invalid beyond any grace period we choose to provide;
- we are required to do so by law, court order, payment network, processor, or regulator; or
- your Account information is inaccurate, incomplete, or misleading.
We may also suspend the Service or specific features for maintenance, security incidents, abuse prevention, legal compliance, or operational necessity.
You may stop using the Service at any time. If you close your Account or cancel a subscription, Sections that by their nature should survive will survive, including sections on fees, Token treatment, intellectual property, disclaimers, liability limitations, dispute resolution, and records retention.
21. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," TO THE MAXIMUM EXTENT PERMITTED BY LAW. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LEVEL OF PERFORMANCE.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
- OUTPUT WILL BE UNIQUE, ERROR-FREE, OR SUITABLE FOR YOUR SPECIFIC USE CASE;
- THE SERVICE WILL MEET ANY CERTIFIED RANDOMNESS, REGULATORY, OR AUDIT REQUIREMENT;
- ANY DOCUMENTATION OR USAGE GUIDANCE WILL BE ERROR-FREE;
- ANY SECURITY MEASURE WILL PREVENT EVERY INCIDENT; OR
- THE SERVICE WILL ALWAYS BE COMPATIBLE WITH YOUR APPLICATIONS, INFRASTRUCTURE, OR THIRD-PARTY PROVIDERS.
YOU ARE SOLELY RESPONSIBLE FOR VALIDATING WHETHER THE SERVICE AND OUTPUT ARE APPROPRIATE FOR YOUR USE.
22. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS INTERRUPTION, OR PROCUREMENT OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.
- OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.
These limitations apply regardless of the theory of liability and even if any limited remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
23. Indemnification
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless the Company and its affiliates, officers, directors, employees, contractors, licensors, and agents from and against any third-party claims, demands, investigations, actions, damages, losses, liabilities, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- your use of the Service;
- your User Content;
- your products, services, or downstream use of Output;
- your breach of these Terms;
- your violation of applicable law; or
- your infringement or misappropriation of any third-party rights.
We reserve the right to assume exclusive defense and control of any matter subject to indemnification at your expense, and you will cooperate with us in that defense.
24. Governing Law and Dispute Resolution
These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be governed by the laws of Turkiye, without regard to conflict-of-laws principles.
Any dispute will be resolved exclusively in the courts of Turkiye, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property, confidential information, or platform security.
If you are a consumer residing in a jurisdiction that gives you the right to bring claims in your local courts or under mandatory local law, that local law and forum entitlement will apply to the extent required and cannot be waived by these Terms.
25. Changes to the Service and to These Terms
We may modify the Service, Documentation, pricing, billing processes, technical limits, supported generators, or supported locales from time to time.
We may also update these Terms. If we make a material change, we will provide notice by posting the updated Terms, emailing the address associated with your Account, displaying an in-product notice, or using another reasonable method. Unless a different effective date is stated, updated Terms become effective when posted.
If you continue to use the Service after updated Terms become effective, you agree to the revised Terms. If you do not agree, you must stop using the Service and cancel any active subscription before the next renewal where applicable.
26. Electronic Communications
You agree to receive electronic communications from us, including notices, disclosures, invoices, receipts, security alerts, billing messages, policy updates, and transactional emails relating to your Account or the Service.
You are responsible for keeping your email address current. Notices we send electronically will satisfy any legal communication requirement to the extent permitted by law.
27. Miscellaneous
These Terms, together with any incorporated policies and any applicable order form or offer-specific terms, are the entire agreement between you and us regarding the Service and supersede prior or contemporaneous understandings on that subject.
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce a provision is not a waiver of that provision or any other provision.
You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, or sale of assets, or by operation of law.
We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, labor disputes, infrastructure failures, internet outages, civil unrest, war, terrorism, government action, denial-of-service attacks, or failures of third-party providers.
